TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms.

For Advertisers (including agents, builders, and developers), these Terms also include the Listing Agreement, which is incorporated by reference. In the event of any inconsistency between these Terms and the Listing Agreement regarding listing specifics, the Listing Agreement shall prevail.

2. Description of Services

HALP operates specialized property discovery and business directory platforms, connecting property seekers with providers and offering supporting tools (calculators, alerts, education). HALP is an information platform — not a real estate agent, developer, builder, or financial adviser.

3. User Accounts and Registration

You must be at least 18 and provide accurate information. You are responsible for your account credentials. We may suspend or terminate accounts that breach these Terms.

4. User Conduct and Prohibited Activities

You agree to comply with applicable laws and not to misuse our services (no unauthorised scraping, harmful content, illegal activity, harassment or commercial misuse). Violations may result in suspension, listing removal or legal action.

5. Property Listings and Information

Listings are provided by third parties. We take reasonable steps to display accurate information but do not warrant it. Always verify critical details — including price, availability and school zones — directly with the property provider and relevant authorities.

6. Business Directory Listings

Advertisers must hold a valid ABN/ACN and applicable licences, comply with the Australian Consumer Law, and manage inquiries in accordance with privacy law. Listings that breach these Terms may be removed.

7. Payment Terms (Advertiser Subscriptions)

All fees are in AUD, displayed exclusive of GST unless stated. Payments are processed by Stripe. Subscriptions auto-renew unless cancelled with pro-rata refunds only for technical issues preventing access.

8. Intellectual Property Rights

All HALP-owned content is protected. Users receive a limited, non-exclusive licence to use the platforms for personal, non-commercial purposes. User-generated content remains yours but you grant HALP a worldwide, royalty-free licence to use it.

9. Disclaimers and Limitations

HALP does not provide financial, legal, tax or real estate advice. Calculators are estimates only. Third-party services (AWS, Stripe, etc.) may impact availability.

10. Limitation of Liability

To the maximum extent permitted by law, HALP excludes liability for indirect and consequential damages. Where liability cannot be excluded, it is capped at $100 AUD (free services) or the lesser of $1,000 AUD or fees paid in the prior 12 months (paid services). Nothing excludes rights under the Australian Consumer Law.

11. Dispute Resolution

Governed by the laws of New South Wales, Australia. Contact legal@halp.com.au for informal resolution before proceedings. Optional arbitration in Sydney is available under ADRA rules. Class actions are waived to the extent permitted by law.

12. General Provisions

These Terms, together with our Privacy Policy, form the entire agreement. Severability, no waiver, and standard notice provisions apply.

13. Special Terms for Specific Services

Mortgage calculators, school zone data, alerts and mortgage referrals are governed by the specific sub-terms — always confirm details with lenders, schools, education departments and brokers directly.

15. Property Inquiry Routing

Property listing inquiries go directly to the listing agent, developer or builder — HALP does not store or process them. Platform inquiries (Contact Us, Join Us, Advertise With Us) are managed by HALP per our Privacy Policy.

16. Definitions

Platform, User, Content, Property Provider, Advertiser, Personal Information and Listing carry the meanings set out in these Terms.
